Welcome. These terms (the “Terms”) govern your use of tweakingcatstudios.com (the “Site”), operated by Tweaking Cat Studios (“TCS,” “we,” “us”). By using the Site, you agree to these Terms. If you don’t, please don’t use the Site.

The Site

The Site is informational. It describes our studio, our team, and our work. We may change, add, or remove content at any time without notice.

Intellectual property

Everything on the Site - including the text, images, art, logos, layout, code, and the Tweaking Cat Studios name and cat mark - is owned by TCS or used with permission, and is protected by copyright, trademark, and other laws. You may view and share links to the Site for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from any of it without our prior written permission, except as expressly allowed by applicable law (for example, fair use).

Acceptable use

When you use the Site, you agree not to:

• Use the Site in a way that violates any law or someone else’s rights.
• Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems.
• Scrape or harvest content for commercial purposes without our permission.
• Impersonate TCS, our team, or anyone else.

Third-party links and services

The Site links to third-party services such as Discord, Instagram, GitHub, and Google Fonts. Those services are operated by other companies and have their own terms and privacy policies. We’re not responsible for them, and your use of those services is between you and them.

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties - express or implied - about the Site, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. The Site may contain errors or be unavailable from time to time.

Limitation of liability

To the fullest extent permitted by law, TCS and its team, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site, even if we’ve been advised of the possibility. Our total liability for any claim arising out of the Site is limited to one hundred U.S. dollars (US$100).

Indemnity

You agree to indemnify and hold TCS harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms.

Changes to the Terms

We may update these Terms from time to time. When we do, we’ll change the date at the top of the page. Continued use of the Site after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in California, and you consent to the jurisdiction of those courts. If you live somewhere where local law gives you stronger consumer protections, those still apply.
